Privacy Policy & Terms of Use

This policy covers the Soniji website, the Soniji Android app on Google Play, and the Soniji iOS app on the Apple App Store. It is published under the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and the rules made under them.

गोपनीयता नीति एवं उपयोग की शर्तें

यह नीति Soniji वेबसाइट, Google Play पर Soniji Android ऐप और Apple App Store पर Soniji iOS ऐप — तीनों पर लागू होती है। यह डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 तथा सूचना प्रौद्योगिकी अधिनियम, 2000 और उनके नियमों के अंतर्गत प्रकाशित है।

The short version

  • Your catalogue, bills and customer entries stay on your device unless you choose to back them up or share them.
  • We never sell your data and we never send marketing on your behalf.
  • Gold and silver rates in the app are indicative only. They are not a quote, not investment advice, and not guaranteed to be correct or current.
  • Soniji is a calculator, not a valuer. Every trade, price and bill is your own commercial decision.
  • You can delete your account and data at any time by writing to us.

Who we are

Soniji is owned and operated by ATOILZ Private Limited, a company registered in India, at C/O Rawal Chand Soni Chunni Lal, 23/686 CHB, Jodhpur, Rajasthan 342001. In this policy "we", "us", "our", "ATOILZ" and "Soniji" mean that company; "you" and "user" mean the person or shop using the website or the app. For the purposes of the Digital Personal Data Protection Act, 2023, ATOILZ Private Limited is the Data Fiduciary and you are the Data Principal.

By downloading, installing or using Soniji, or by using this website, you accept this policy and the terms in sections 13 to 15 in full. If you do not accept them, please stop using Soniji and uninstall the app.

हम कौन हैं

Soniji का स्वामित्व और संचालन ATOILZ Private Limited के पास है — भारत में पंजीकृत कंपनी, पता: C/O रावल चंद सोनी चुन्नी लाल, 23/686 CHB, जोधपुर, राजस्थान 342001। इस नीति में "हम", "हमारा", "ATOILZ" और "Soniji" का अर्थ यही कंपनी है; "आप" या "उपयोगकर्ता" का अर्थ वेबसाइट या ऐप का उपयोग करने वाला व्यक्ति या दुकान है। डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 के अनुसार ATOILZ Private Limited डेटा फ़िड्यूशरी है और आप डेटा प्रिंसिपल हैं।

Soniji डाउनलोड, इंस्टॉल या उपयोग करने से, अथवा इस वेबसाइट के उपयोग से, आप इस नीति तथा धारा 13 से 15 की शर्तों को पूर्ण रूप से स्वीकार करते हैं। यदि आप सहमत नहीं हैं तो कृपया Soniji का उपयोग बंद करें और ऐप अनइंस्टॉल कर दें।

Laws we follow

This policy is drawn up under Indian law, and in particular:

  • the Digital Personal Data Protection Act, 2023 (DPDP Act) and rules made under it;
  • the Information Technology Act, 2000, including sections 43A and 72A;
  • the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
  • the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent applicable;
  • the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, to the extent applicable.

Where Google Play or Apple App Store policies require additional disclosures, those disclosures are given in sections 5 and 6.

यह नीति भारतीय कानून के अंतर्गत बनाई गई है, विशेष रूप से:

  • डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 (DPDP Act) एवं उसके नियम;
  • सूचना प्रौद्योगिकी अधिनियम, 2000 — धारा 43A एवं 72A सहित;
  • सूचना प्रौद्योगिकी (उचित सुरक्षा प्रथाएँ एवं संवेदनशील व्यक्तिगत डेटा) नियम, 2011;
  • सूचना प्रौद्योगिकी (मध्यवर्ती दिशानिर्देश एवं डिजिटल मीडिया आचार संहिता) नियम, 2021 — जहाँ लागू हो;
  • उपभोक्ता संरक्षण अधिनियम, 2019 एवं उपभोक्ता संरक्षण (ई-कॉमर्स) नियम, 2020 — जहाँ लागू हो।

जहाँ Google Play या Apple App Store की नीतियाँ अतिरिक्त जानकारी माँगती हैं, वह धारा 5 और 6 में दी गई है।

Data we collect

We keep collection to the minimum needed to run the app.

  • Shop and account details you type in: your name, mobile number, shop name, address, GSTIN if you choose to add it, and your shop logo.
  • Work you create in the app: item entries, weights, purity, making charges, catalogue photos, estimates and bills, and any customer name or number you add to a bill.
  • Device and app data: device model, operating system version, app version, language, crash logs and basic usage events (for example, which screens are opened).
  • City selection for the rate board. We use the city you pick, not your GPS position.
  • Messages you send us on WhatsApp, phone or email, and our replies.

Purchases, if any, are handled by Google Play or Apple. They tell us only that a purchase succeeded — we never see your card, UPI or bank details.

हम केवल उतना ही डेटा लेते हैं जितना ऐप चलाने के लिए ज़रूरी है।

  • ऐप में बनाया गया काम: आइटम, वज़न, शुद्धता, मज़दूरी, कैटलॉग फ़ोटो, अनुमान व बिल, तथा बिल में जोड़ा गया ग्राहक का नाम या नंबर।
  • डिवाइस व ऐप डेटा: डिवाइस मॉडल, OS वर्ज़न, ऐप वर्ज़न, भाषा, क्रैश लॉग और सामान्य उपयोग घटनाएँ (जैसे कौन-सी स्क्रीन खुली)।
  • शहर का चयन भाव बोर्ड के लिए। हम आपका चुना शहर उपयोग करते हैं, GPS स्थान नहीं।
  • आपके संदेश — व्हाट्सएप, फ़ोन या ईमेल पर — और हमारे उत्तर।

भुगतान, यदि कोई हो, Google Play या Apple द्वारा संभाले जाते हैं। वे हमें केवल यह बताते हैं कि भुगतान सफल हुआ — आपका कार्ड, UPI या बैंक विवरण हम कभी नहीं देखते।

Data we never collect

  • Aadhaar number, PAN, or any government ID document.
  • Biometric data, fingerprints or face data.
  • Card numbers, CVV, UPI PIN, bank account or passbook details.
  • Your contact list, SMS messages, call logs or WhatsApp chats.
  • Continuous or background GPS location.
  • Health data, caste, religion, political belief or any other special category of data.

Please do not send us such information. If you send it anyway, we will delete it and we accept no responsibility for it.

  • आधार नंबर, PAN या कोई सरकारी पहचान दस्तावेज़।
  • बायोमेट्रिक डेटा, फ़िंगरप्रिंट या चेहरे का डेटा।

कृपया ऐसी जानकारी हमें न भेजें। यदि आप भेजते हैं तो हम उसे मिटा देंगे और उसके लिए हमारी कोई ज़िम्मेदारी नहीं होगी।

Android app — permissions and Play Data Safety

The Soniji Android app (Google Play, package com.gramtotolaconvertor) asks only for these permissions, and only when the feature is used:

  • Internet / network state — to fetch rates and sync, if you enable sync.
  • Camera — only when you tap to photograph a design or your shop logo.
  • Photos and media (selected files) — only for the images you pick, using the Android photo picker where available.
  • Notifications — for rate alerts and order reminders. You may refuse or turn these off in Android settings.
  • Storage write for exports — to save a bill or estimate PDF you asked for.

We do not request contacts, SMS, call log, precise location or accessibility permissions. Our Google Play Data Safety declaration matches this section; data is encrypted in transit and you can request deletion as described in section 10. Crash and performance data may be processed through Google Play services and Firebase Crashlytics.

Android ऐप — अनुमतियाँ और Play Data Safety

Soniji Android ऐप (Google Play, पैकेज com.gramtotolaconvertor) केवल ये अनुमतियाँ माँगता है, और वह भी तब जब वह सुविधा उपयोग हो:

हम कॉन्टैक्ट, SMS, कॉल लॉग, सटीक स्थान या एक्सेसिबिलिटी अनुमति नहीं माँगते। हमारी Google Play Data Safety घोषणा इसी धारा के अनुरूप है; डेटा ट्रांज़िट में एन्क्रिप्टेड रहता है और आप धारा 10 के अनुसार विलोपन माँग सकते हैं। क्रैश व प्रदर्शन डेटा Google Play services तथा Firebase Crashlytics के माध्यम से प्रोसेस हो सकता है।

iOS app — permissions, tracking and privacy labels

The Soniji iOS app (App Store ID 6757489889) asks for permission at the moment you first use the feature, and the app works without them:

  • Camera — to photograph a design or logo.
  • Photo library (limited access) — only the photos you select.
  • Notifications — rate alerts and reminders.

We do not use App Tracking Transparency tracking: we do not read the IDFA, we do not track you across other companies' apps or websites, and we do not use your data for third-party advertising. Our App Store privacy labels declare data as "not linked to you" except account and shop details you enter, which are linked to your account so the app can work. Apple may separately collect data under its own privacy policy; Apple is not responsible for Soniji and Soniji is not endorsed by Apple.

iOS ऐप — अनुमतियाँ, ट्रैकिंग व प्राइवेसी लेबल

Soniji iOS ऐप (App Store ID 6757489889) अनुमति उसी समय माँगता है जब आप वह सुविधा पहली बार उपयोग करें; इनके बिना भी ऐप चलता है:

  • कैमरा — डिज़ाइन या लोगो की फ़ोटो के लिए।
  • फ़ोटो लाइब्रेरी (सीमित पहुँच) — केवल वे तस्वीरें जो आप चुनें।
  • नोटिफ़िकेशन — भाव अलर्ट व रिमाइंडर।

हम App Tracking Transparency वाली ट्रैकिंग नहीं करते: IDFA नहीं पढ़ते, दूसरी कंपनियों के ऐप या वेबसाइट पर आपको ट्रैक नहीं करते, और आपके डेटा का उपयोग तीसरे पक्ष के विज्ञापन के लिए नहीं करते। App Store प्राइवेसी लेबल में डेटा "आपसे जुड़ा नहीं" घोषित है, सिवाय उस खाता व दुकान विवरण के जो आप स्वयं भरते हैं। Apple अपनी नीति के अंतर्गत अलग से डेटा ले सकता है; Apple Soniji के लिए उत्तरदायी नहीं है और Soniji को Apple का समर्थन प्राप्त नहीं है।

Why we use your data

We process your data only for these purposes, and only on the basis of your consent given when you use the feature, or as a legitimate use permitted by the DPDP Act:

  • to run the conversions, estimates, catalogue and billing features you asked for;
  • to put your shop name and logo on the bills and estimates you generate;
  • to show the rate board for the city you pick;
  • to fix crashes, improve performance and decide which features to build;
  • to answer your support messages;
  • to meet a legal, tax or court requirement.

We do not use your data for automated decisions about you, and we do not profile you for advertising.

हम आपका डेटा केवल इन कामों के लिए उपयोग करते हैं — आपकी सहमति के आधार पर, या DPDP अधिनियम द्वारा अनुमत वैध उपयोग के रूप में:

  • किसी कानूनी, कर या न्यायालय संबंधी आवश्यकता को पूरा करने के लिए।

हम आपके बारे में स्वचालित निर्णय नहीं लेते और विज्ञापन के लिए प्रोफ़ाइलिंग नहीं करते।

Sharing and disclosure

We do not sell, rent or trade your personal data. We share it only with:

  • Data processors who work under contract for us — hosting, database, crash reporting, notification delivery and rate data providers — and only to the extent needed for that service;
  • Google and Apple, for app distribution, purchases and crash reporting under their own policies;
  • the recipient you choose when you yourself send a bill, estimate or catalogue on WhatsApp or by any other channel — that sharing is your act, not ours;
  • authorities, where disclosure is required by law, a court order, or a lawful request under the Information Technology Act, 2000 or the Code of Criminal Procedure;
  • a successor entity, if ATOILZ is merged, acquired or reorganised, with this policy continuing to apply.

  • उत्तराधिकारी कंपनी — यदि ATOILZ का विलय, अधिग्रहण या पुनर्गठन हो, तो यह नीति लागू रहेगी।

Storage, retention and security

Most of your work — items, weights, estimates, catalogue — is stored on your own device. If you turn on backup or sync, a copy is stored on servers located in India, with limited processing abroad only where a provider requires it, subject to Indian law.

We keep account data while your account is active, and for up to 180 days after deletion for backup rotation and legal records, after which it is erased or anonymised. Invoices and tax records may be kept longer where a law requires it. We use reasonable security practices — encryption in transit, access control, and least-privilege staff access — in line with the IT (Reasonable Security Practices) Rules, 2011. No system is perfectly secure; you are responsible for your device, your screen lock and who you hand your phone to. In the event of a personal data breach we will notify the Data Protection Board of India and affected users as required by the DPDP Act.

भंडारण, अवधि व सुरक्षा

आपका ज़्यादातर काम — आइटम, वज़न, अनुमान, कैटलॉग — आपके ही फ़ोन में सुरक्षित रहता है। यदि आप बैकअप या सिंक चालू करते हैं तो एक प्रति भारत में स्थित सर्वरों पर रखी जाती है; विदेश में सीमित प्रोसेसिंग केवल वहाँ होती है जहाँ कोई प्रदाता ऐसा माँगे, और वह भी भारतीय कानून के अधीन।

खाता डेटा तब तक रखा जाता है जब तक खाता सक्रिय है, और विलोपन के बाद अधिकतम 180 दिन तक बैकअप व कानूनी अभिलेख हेतु; उसके बाद मिटा या अनामित कर दिया जाता है। बिल व कर अभिलेख कानून की आवश्यकता होने पर अधिक समय तक रखे जा सकते हैं। हम IT (उचित सुरक्षा प्रथाएँ) नियम, 2011 के अनुरूप उचित सुरक्षा उपाय अपनाते हैं — ट्रांज़िट एन्क्रिप्शन, पहुँच नियंत्रण व सीमित स्टाफ़ पहुँच। कोई भी प्रणाली पूर्ण सुरक्षित नहीं होती; अपने फ़ोन, स्क्रीन लॉक और उसे किसे देते हैं — इसकी ज़िम्मेदारी आपकी है। डेटा उल्लंघन की स्थिति में हम DPDP अधिनियम के अनुसार भारतीय डेटा संरक्षण बोर्ड तथा प्रभावित उपयोगकर्ताओं को सूचित करेंगे।

Your rights under the DPDP Act

  • Access — a summary of the personal data we hold about you and how it is processed.
  • Correction and completion — to fix wrong or incomplete details.
  • Erasure — to have your data deleted, unless a law requires us to keep it.
  • Withdraw consent — at any time, with the same ease you gave it; the app will then stop the related feature.
  • Grievance redressal — to complain to our Grievance Officer first (section 16), and then to the Data Protection Board of India.
  • Nominate — to name a person to exercise these rights if you die or become incapacitated.

To use any of these rights, write to prahlad@atoilz.com from your registered email, or message +91 90243 82337, with your name, shop name and registered mobile number. We reply within 30 days. You may also delete the app's data from within the app where that option is provided. Please note the DPDP Act also places duties on you: you must give true information and must not file a false or frivolous complaint.

DPDP अधिनियम के तहत आपके अधिकार

  • पहुँच — हमारे पास आपका कौन-सा डेटा है और उसका उपयोग कैसे होता है, इसका सारांश।
  • सुधार व पूर्णता — गलत या अपूर्ण विवरण ठीक कराना।
  • विलोपन — अपना डेटा मिटवाना, जब तक कानून उसे रखना अनिवार्य न करे।
  • सहमति वापस लेना — कभी भी, उतनी ही आसानी से जितनी सहमति दी थी; तब वह सुविधा बंद हो जाएगी।
  • शिकायत निवारण — पहले हमारे शिकायत अधिकारी को (धारा 16), फिर भारतीय डेटा संरक्षण बोर्ड को।
  • नामांकन — मृत्यु या अक्षमता की स्थिति में इन अधिकारों का उपयोग करने वाले व्यक्ति का नाम देना।

Children

Soniji is a business tool meant for persons aged 18 and above. We do not knowingly collect data of children, and in line with the DPDP Act we do not track children, serve them advertising, or process their data in any way likely to harm them. If a child's data reaches us, write to us and we will delete it.

Gold and silver rates carry no warranty of any kind

Rates shown in the Soniji app and on this website are indicative reference figures collected from public sources, third-party feeds and market reports. They are provided on an "as is" and "as available" basis.

  • We give no warranty or guarantee — express or implied — that any rate is accurate, current, complete, uninterrupted, or applicable to your city, your bullion dealer or your purity.
  • Rates may be delayed, stale, mis-stated, wrongly converted, or unavailable. Feeds fail. Markets move between refreshes.
  • A rate shown in Soniji is not an offer, quotation, bid, valuation, hallmark certification or price commitment by ATOILZ, and creates no contract of any kind.
  • Nothing in Soniji is investment, trading, tax or legal advice. We are not a broker, dealer, investment adviser, assayer or valuer, and are not registered as any of these.
  • Estimates, labour charges, wastage, purity conversions, GST figures and bills produced by the app are arithmetic on the numbers you enter. Checking them, and complying with GST, BIS hallmarking and every other law, is entirely your responsibility.

Always confirm the live rate with your own bullion source before you buy, sell, quote or bill. Any decision you take on the basis of a rate or calculation in Soniji is taken entirely at your own risk and on your own commercial judgement.

Soniji ऐप और इस वेबसाइट पर दिखाए भाव केवल सांकेतिक संदर्भ आंकड़े हैं, जो सार्वजनिक स्रोतों, तीसरे पक्ष के फ़ीड और बाज़ार रिपोर्टों से लिए जाते हैं। ये "जैसे हैं, जैसे उपलब्ध हैं" के आधार पर दिए जाते हैं।

  • भाव देर से आ सकते हैं, पुराने हो सकते हैं, गलत दर्ज या गलत परिवर्तित हो सकते हैं, या उपलब्ध ही न हों। फ़ीड बंद हो सकते हैं। दो रिफ़्रेश के बीच बाज़ार बदल जाता है।
  • Soniji में दिखाया भाव ATOILZ की ओर से कोई प्रस्ताव, कोटेशन, बोली, मूल्यांकन, हॉलमार्क प्रमाणन या मूल्य वचन नहीं है, और इससे कोई अनुबंध नहीं बनता।
  • Soniji में कुछ भी निवेश, व्यापार, कर या कानूनी सलाह नहीं है। हम ब्रोकर, डीलर, निवेश सलाहकार, परखकर्ता या मूल्यांकनकर्ता नहीं हैं और इनमें से किसी रूप में पंजीकृत नहीं हैं।
  • ऐप द्वारा बनाए अनुमान, मज़दूरी, घिसाई, शुद्धता गणना, GST और बिल आपके भरे अंकों का गणित हैं। उन्हें जाँचना तथा GST, BIS हॉलमार्किंग व अन्य सभी कानूनों का पालन करना पूर्णतः आपकी ज़िम्मेदारी है।

खरीदने, बेचने, भाव बताने या बिल बनाने से पहले लाइव भाव अपने सर्राफ़ा स्रोत से स्वयं पक्का करें। Soniji के किसी भाव या गणना के आधार पर लिया गया निर्णय पूर्णतः आपके जोखिम और आपके व्यापारिक विवेक पर है।

Disclaimer, limitation of liability, release and indemnity

1. Service as is. Soniji is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, ATOILZ excludes all warranties, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability.

2. No liability for your losses. To the fullest extent permitted by law, ATOILZ, its directors, employees, agents, contractors and data processors shall not be liable for any loss or damage of any kind arising out of or connected with your use of, or inability to use, Soniji — including loss of profit, loss of stock or metal, wrong rate, wrong weight, wrong purity, wrong or unsent bill, under-quoting or over-quoting, tax demand, penalty, interest, loss of customers, loss of goodwill, loss or corruption of data, device failure, network or feed failure, or any direct, indirect, incidental, special, consequential, exemplary or punitive damage — even if we were told such loss was possible.

3. Cap on any claim. If, despite the above, ATOILZ is held liable by a competent authority, its total aggregate liability for all claims taken together shall not exceed the amount you actually paid to ATOILZ for Soniji in the three months before the event, or ₹1,000, whichever is lower. Where the app was used free of charge, that liability is nil.

4. Release. You use Soniji at your sole risk and as a commercial user exercising your own skill and judgement as a jeweller, karigar or trader. You release and waive all claims, demands, suits, complaints and causes of action against ATOILZ arising from any rate, conversion, estimate, bill, notification, outage or data loss in Soniji, and you agree not to file or support any claim against ATOILZ on those grounds.

5. Indemnity. You agree to indemnify and hold ATOILZ harmless from any claim, loss, penalty, tax demand, legal cost or proceeding brought by your customer, your supplier, any authority or any third party arising from your use of Soniji, the bills or estimates you issue, the data you enter, or your breach of any law.

6. No agency. ATOILZ is not a party to any transaction between you and your customer or supplier, holds no metal, handles no trade, and gives no assurance about any counterparty.

7. Service changes. We may change, suspend, limit or discontinue any feature, rate source or the whole app at any time, without notice and without liability.

Note as required by law: nothing in this policy takes away any right that Indian law does not allow to be taken away — including statutory rights of a consumer under the Consumer Protection Act, 2019 and liability that cannot be excluded for fraud, wilful misconduct or gross negligence. Every other limitation above applies to the fullest extent the law permits, and each clause stands on its own if another is held unenforceable.

अस्वीकरण, दायित्व की सीमा, छूट व क्षतिपूर्ति

1. सेवा जैसी है। Soniji "जैसा है" और "जैसा उपलब्ध है" के आधार पर, बिना किसी गारंटी के दिया जाता है। कानून द्वारा अनुमत पूर्ण सीमा तक ATOILZ सभी गारंटियाँ — प्रत्यक्ष, अप्रत्यक्ष या वैधानिक — अस्वीकार करता है, जिसमें व्यापारिक उपयुक्तता, किसी विशेष उद्देश्य हेतु उपयुक्तता, सटीकता, गैर-उल्लंघन और निरंतर उपलब्धता शामिल हैं।

2. आपके नुकसान का कोई दायित्व नहीं। कानून द्वारा अनुमत पूर्ण सीमा तक ATOILZ, उसके निदेशक, कर्मचारी, एजेंट, ठेकेदार व डेटा प्रोसेसर, Soniji के उपयोग या उपयोग न कर पाने से जुड़े किसी भी नुकसान के लिए उत्तरदायी नहीं होंगे — जिसमें लाभ हानि, माल या धातु की हानि, गलत भाव, गलत वज़न, गलत शुद्धता, गलत या न भेजा गया बिल, कम या अधिक भाव बताना, कर मांग, जुर्माना, ब्याज, ग्राहक हानि, प्रतिष्ठा हानि, डेटा हानि या भ्रष्टता, डिवाइस खराबी, नेटवर्क या फ़ीड विफलता, तथा कोई भी प्रत्यक्ष, अप्रत्यक्ष, आनुषंगिक, विशेष, परिणामी या दंडात्मक क्षति शामिल है — चाहे हमें ऐसी हानि की संभावना बताई गई हो।

3. दावे की अधिकतम सीमा। यदि उपरोक्त के बावजूद किसी सक्षम प्राधिकरण द्वारा ATOILZ को उत्तरदायी ठहराया जाए, तो सभी दावों को मिलाकर कुल दायित्व उस राशि से अधिक नहीं होगा जो आपने घटना से पूर्व तीन महीनों में Soniji के लिए ATOILZ को वास्तव में चुकाई है, अथवा ₹1,000 — जो भी कम हो। निःशुल्क उपयोग की स्थिति में यह दायित्व शून्य है।

4. छूट। आप Soniji का उपयोग पूर्णतः अपने जोखिम पर, एक व्यापारिक उपयोगकर्ता के रूप में, सुनार/कारीगर/व्यापारी के अपने कौशल व विवेक से करते हैं। आप Soniji के किसी भाव, गणना, अनुमान, बिल, नोटिफ़िकेशन, सेवा-बाधा या डेटा हानि से उत्पन्न सभी दावे, मांगें, मुकदमे, शिकायतें व वाद-कारण ATOILZ के विरुद्ध छोड़ते हैं, और सहमत हैं कि इन आधारों पर ATOILZ के विरुद्ध कोई दावा दायर या समर्थित नहीं करेंगे।

5. क्षतिपूर्ति। आपके Soniji उपयोग, आपके जारी किए बिल या अनुमान, आपके भरे डेटा, अथवा आपके द्वारा किसी कानून के उल्लंघन से उत्पन्न — आपके ग्राहक, आपूर्तिकर्ता, किसी प्राधिकरण या तीसरे पक्ष द्वारा लाए गए — किसी दावे, हानि, जुर्माने, कर मांग, कानूनी खर्च या कार्यवाही से आप ATOILZ को क्षतिपूर्ति देंगे और सुरक्षित रखेंगे।

6. कोई एजेंसी नहीं। ATOILZ आपके और आपके ग्राहक या आपूर्तिकर्ता के बीच किसी लेन-देन का पक्षकार नहीं है, कोई धातु नहीं रखता, कोई सौदा नहीं करता, और किसी प्रतिपक्ष के बारे में कोई आश्वासन नहीं देता।

7. सेवा में बदलाव। हम किसी भी सुविधा, भाव स्रोत या पूरे ऐप को कभी भी, बिना सूचना और बिना दायित्व, बदल, रोक, सीमित या बंद कर सकते हैं।

कानून के अनुसार आवश्यक टिप्पणी: इस नीति से वह कोई अधिकार नहीं छिनता जिसे भारतीय कानून छीनने की अनुमति नहीं देता — जिसमें उपभोक्ता संरक्षण अधिनियम, 2019 के अंतर्गत उपभोक्ता के वैधानिक अधिकार तथा धोखाधड़ी, जानबूझकर किए कदाचार या घोर उपेक्षा का दायित्व शामिल है। उपरोक्त प्रत्येक अन्य सीमा कानून द्वारा अनुमत पूर्ण सीमा तक लागू है, और कोई एक खंड अप्रवर्तनीय ठहराए जाने पर शेष खंड स्वतंत्र रूप से प्रभावी रहेंगे।

Governing law, arbitration and jurisdiction

This policy and your use of Soniji are governed by the laws of India. Before starting any proceeding, you agree to write to our Grievance Officer and allow 60 days for the matter to be resolved amicably.

Any dispute that remains shall be referred to arbitration by a sole arbitrator appointed by ATOILZ, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jodhpur, Rajasthan, the language shall be English, and the award shall be final and binding. Subject to that, the courts at Jodhpur, Rajasthan alone shall have exclusive jurisdiction. Claims may be brought only in your individual capacity — not as a class, representative or collective action.

लागू कानून, मध्यस्थता व क्षेत्राधिकार

यह नीति और Soniji का आपका उपयोग भारत के कानूनों द्वारा शासित है। कोई भी कार्यवाही शुरू करने से पहले आप हमारे शिकायत अधिकारी को लिखेंगे और मामले के सौहार्दपूर्ण समाधान हेतु 60 दिन का समय देंगे।

शेष रहने वाला कोई भी विवाद मध्यस्थता एवं सुलह अधिनियम, 1996 के अंतर्गत ATOILZ द्वारा नियुक्त एकल मध्यस्थ को भेजा जाएगा। मध्यस्थता का स्थान व आसन जोधपुर, राजस्थान होगा, भाषा अंग्रेज़ी होगी, और निर्णय अंतिम व बाध्यकारी होगा। इसके अधीन, केवल जोधपुर, राजस्थान के न्यायालयों को विशेष क्षेत्राधिकार होगा। दावे केवल व्यक्तिगत रूप से किए जा सकते हैं — सामूहिक या प्रतिनिधि कार्यवाही के रूप में नहीं।
